GENERAL SALE CONDITIONS
ART. 1 - ORGANIZATION, APPLICABLE RULES
The tourist package, object of the contract, is organized by the Tour Operator Discover Italy Now. The contract is governed by the following provisions and the Legislative Decree 16 March 1995, Directive 90/314/EEC and by international agreements on the subject, and in particular the Brussels Convention of 20 April 1970, implemented by the Law 19 December 1977 No 1084, the Warsaw Convention of 12 October 1929 on International Carriage by Air Act and enforced with the Law of May 19, 1932, No 41, the Berne Convention of 25 February 1961 on rail transport, implemented by Act March 2, 1963, No 1086, as applicable to the services of the tourist package, as well as the provisions of the Civil Code and other rules, as not departed from the provisions of this contract.
ART. 2 - CONTENT OF CONTRACT / DESCRIPTION OF THE TOURIST PACKAGE
This contract consists of General Conditions here reported, the Special Conditions above as well as the catalogue of the program indicated in the Special Conditions. The description of the tourist package which the contract refers to, is contained in the Special Conditions, supplemented by the descriptions in the online offers.
ART. 3 - PRICE / REVIEW / PURCHASE MONEY
The price of the package is fixed in the special conditions of this contract. This price may be amended only in dependence of variations in the cost of housing, transport, fuel, duties and taxes, such as (by way of example and not limitation) the fees for boarding and disembarking at ports and airports, and the exchange rate applied. The price revision will be determined in proportion to the variation of these elements and the traveler will be given the indication of the price that caused the change itself.
Travels with regular use of carriers and hotels:
At the moment of booking confirmation, the traveler must pay a deposit of 30% of the overall price of the services purchased in addition to the booking fees, if applicable *. The balance must be paid 20 days before the departure. If the reservation is made at a later date to the one, as above calculated, planned for the balance of the price, the traveler will place the payment contextually to the booking.* This percentage may vary depending on the product purchased, hotel rates and air fare rules applied and consequently imposed by carriers and suppliers. Further information will be provided from our offices
ART. 4 - ASSIGNMENT OF CONTRACT
The traveler, when unable to make use of the tourist package can assign the contract to a third party, on condition that it meets all the conditions and requirements for the use of the tourist package. In this case, the traveler must give notice of his intention to assign the contract to the organizer via registered mail or, in urgent cases, by telegram or fax, which will arrive within four working days before departure, indicating the particulars of the transferee (name, surname, date of birth, nationality, etc. ...).With the assignment fees to fix will be charged.
ART. 6 - WITHDRAWAL / CANCELLATION
The traveller has the right to recede from the contract without paying any penalty in the following cases:
1) increase in the price of the tourist package shown on the website or contract exceeding of 10%
2) significant changes of the contract requirements after the conclusion of the organization, not accepted by the traveller. For this purpose it is stated that the traveller must provide written notice to the Organization through the travel agency of his choice to accept or to withdraw within two business days after the receipt of the modification proposal.
In the mentioned cases, or when the organizer cancels the package prior to departure for any reason except for the fault of the traveller himself, it has the following alternative rights:
1) use a substitute package of equivalent quality or, if not available, higher at no extra cost, or another package 2) receiving the money already paid, within seven working days from when the notice of intention to withdraw or to accept the alternative solution, according to the following paragraph, or cancellation. The traveller must put on paper and communicate to the Organizer his decision to withdraw or to alternate with the package, not later than two days from the receipt of the alternative proposal. Moreover, where it provides specific evidence, the traveller is also entitled to additional compensation for any damage he had suffered as a dependency of breach of contract.
The traveller is not entitled to compensation for any damage he had suffered more depending on the non-performance of contract. The traveller is also not entitled to compensation for further damages, when the cancellation of the trip depends on the failure to reach the minimum number of participants of the organization for group travel, and the traveller has received notice of the failure at least 10 days before the date fixed for the departure, or when the cancellation is due to causes beyond our control. Unless expressly indicated the number of participants per group departures is at least 20.
3) Vacation packages with scheduled flights at special rate or IT group tour packages and other means of transport:
- 10% of the price up to 30 calendar days prior to departure;
- 30% of the price from 29 to 18 calendar days prior to departure;
- 50% of the price from 17 to 10 calendar days prior to departure;
- 75% of the share calendar days from 9 to 3 business days (excluding Saturdays, however, prior to departure);
- 100% of the fee after such terms.
4) If the traveller mean to withdraw from the contract outside the presumptions listed above, for travels in Europe operated by individuals or groups from the 30/11 to 07/01 of each year, and / or use of special flights of the carrier * 30% + booking fee from the moment of booking until 21 days prior to departure, 75% + fees, from 20 to 15 days before departure; No refunds after that date.
* Cancellation of flight tickets only: penalties to be fixed from time to time according to the rate applied, some service providers apply to the cancellation more restrictive policies than the statement in paragraph 3, according to periods of high season. These will be announced from time to time. NB: The registration fee will in no case be refunded
ART. 7 - CHANGES AFTER DEPARTURE
After the departure, when an essential service under the contract can not be performed, the Organizer shall provide for adequate alternative arrangements for the continuation of the scheduled trips without charges of any kind to the traveler, or reimburse him for the difference between the services originally planned and carried out, except for compensation for extra costs incurred, which are proved by the traveler. If it is not possible to make such arrangements or the traveler does not accept for a justified reason, the organizer provides an equivalent mean of transport back to the place of departure or other place agreed, consistent with the availability of the means and places, and return the difference between the cost of benefits up to the time of anticipated return.
ART. 8 – ORGANIZER
The organizer's responsibility towards the traveler for any damage suffered as a result of the failed or alleged failed attainment lamented by the traveler due to causes imputable the traveler himself, or attributable to a third party unconnected with the provision of benefits under the contract, which is due to case unforeseeable circumstances or force majeure. The organization also can not be responsible for any damages arising from the provision of services not provided by persons outside and not part of the package or that result from autonomous initiatives of the traveler in the course of the journey.
ART. 9 – COMPLAINTS
Any failure in the performance of the contract must be contested by the traveler without delay so that the organization, its local representative or the guide may remedy the situation promptly. The traveler may also file a complaint by sending a registered letter with acknowledgment of receipt to the Organizers and to the seller within 7 days after returning from the trip.
Note: For reservations made through travel agencies, if problems arise during your stay, we urge you to contact us through the Agency with whom the reservation has been completed. Only in this case there will be possible to intervene. For bookings made directly with our office, please contact us directly.
ART. 10 JURISDICTION
Any dispute will be settled by the Court of Milan.
ART. 11 – LIABILIT OF THE CARRIERS
Carriers are responsible towards the travelers only during the transports with their means, in accordance with what contained in their conditions of carriage.
The programs are posted behind the responsibility of the travel organizer, therefore are not published on behalf of the carriers whose services are used during the trip, or when they use them.
ART. 12 - INSURANCE / GUARANTEE FUND
Organizing Committee has concluded, pursuant to art. 20 d. No LGT 111 of 17 March 1995, the following insurance policies:
CIVIL LIABILITY POLICY AND OTHER RISKS
Under Article. 21 d. LGT 111 of 17 March 1995 is set up a guarantee fund at the Presidency of the Council of Ministers in aid to all the travellers in the event of insolvency or bankruptcy of the Seller or of the Organization for the repayment of money paid and repatriation when you travel abroad. The modus operandi of the Guarantee Fund shall be established by decree of the President of the Council of Ministers in consultation with the Secretary of the Treasury.
GENERAL CONDITIONS OF INSURANCE
The registration fee includes an insurance policy ELVIA-inter-assistance 24 h 24, which provides the following services:
- 24h operating station
- Medical Advice
- Passenger’s health return
- Return of an insured family member or travelling companion
- Travel expenses of a family member in case of hospitalization longer than 7 days
- Return of children under 15 years
- Additional costs of living due to illness or accident of the insured
- Return to home recovering from the insured
- Early return to the house of death in the family, up to an amount of € 770
- Send urgent messages
- Send urgent medicines
- Telephone expenses up to € 100
- Available interpreter
- Insurance advance fees abroad
